Acceptable Use Policy
Effective date: June 1, 2026
This Acceptable Use Policy ("AUP") governs your use of the Backstage Baton platform, website, email, and SMS services (the "Service"). It is incorporated into our Terms of Service. Violation may result in suspension or termination of access.
"You" includes the subscribing organization, its administrators, and all members who access the Service through it.
1. Lawful, intended use only
Use the Service only to manage your own ensemble organization's operations — rosters, scheduling, music and equipment, attendance, and member communications. Do not use it for any unlawful purpose or in violation of any applicable law or regulation.
2. Messaging: no spam, consent required
SMS. Text messages may be sent only to members who are on your organization's roster and have opted in to SMS, and must relate to your organization's activities. Honor STOP and HELP responses. You must comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and applicable carrier A2P 10DLC requirements. Do not send marketing, promotional, or third-party content via SMS through the Service.
Email. Use the email relay and communications tools only to reach your own members about organization matters. No unsolicited bulk email, no purchased lists, no phishing. All marketing or commercial messages sent through the Service must comply with the CAN-SPAM Act and any applicable equivalents (CASL in Canada, ePrivacy/GDPR in the EU), including an accurate "from" line, a non-deceptive subject line, and a working unsubscribe mechanism. Backstage Baton appends an unsubscribe link to bulk messages where required; you remain responsible for honoring opt-out requests promptly.
3. Accurate rosters & lawful collection of member data
Only add individuals who have a genuine relationship with your organization. You are responsible for having a lawful basis to store each member's personal data and for any consents required — including verifiable parental or guardian consent for members under 13 under the Children's Online Privacy Protection Act (COPPA), and any other consent or authorization required by applicable law for collecting and processing a minor's data, including under FERPA where you are an educational institution. Keep contact data accurate and remove people who leave the organization.
4. Respect others
Do not use the Service to harass, threaten, defame, or discriminate against anyone, or to transmit content that is unlawful, hateful, obscene, infringing, or otherwise objectionable. Backstage Baton reserves the right to remove content and to suspend access when content or conduct violates this AUP, our Terms, or applicable law, and to comply with lawful requests from law enforcement or court orders.
5. Security & integrity
Do not:
- attempt to access another organization's data or any account that is not yours;
- probe, scan, or test the vulnerability of the Service, or breach or circumvent authentication, authorization, or multi-tenant isolation;
- scrape, crawl, or harvest data except through features provided for export;
- reverse-engineer, decompile, or attempt to extract source code;
- upload viruses, malware, or malicious code;
- send automated traffic that overloads or degrades the Service, or evade rate limits and quotas;
- use the Service to develop a competing product.
Authorized security research is welcome — contact security@backstagebaton.com before any testing so we can coordinate scope, timing, and responsible disclosure.
6. Music & content rights
The Backstage Baton music library is a cataloging and planning tool. You are solely responsible for lawfully obtaining all rights to the music your organization performs, rehearses, copies, or distributes — including public-performance licenses (e.g., ASCAP/BMI/SESAC), publisher rentals, and mechanical or synchronization rights where applicable. Backstage Baton grants no music rights and does not host or distribute copyrighted scores or recordings on your behalf.
Do not upload sheet music, recordings, or other copyrighted material to the Service for which you do not have the necessary rights. Photos, program notes, and similar materials should likewise be uploaded only when you have the rights to do so.
Copyright complaints (DMCA). If you believe content on the Service infringes your copyright, send a written notice under 17 U.S.C. § 512(c) to legal@backstagebaton.com including: (a) your contact information; (b) a description of the work you say is infringed; (c) the location of the allegedly infringing material on the Service; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act; and (f) your physical or electronic signature. We will respond consistent with the DMCA and our policies.
7. No resale or service-bureau use
Do not resell, sublicense, or provide the Service to third parties, or use it to run an organization other than the one(s) covered by your subscription, without our prior written agreement.
8. Quotas & fair use
Plan limits (members, ensembles, email/SMS quotas) and rate limits exist to keep the Service reliable for everyone. Do not attempt to circumvent them.
9. Enforcement
We may investigate suspected violations and may suspend or terminate access — with or without notice for serious or ongoing violations, or for conduct that threatens the Service, other customers, or third parties. Where practical we will give notice and a reasonable chance to cure. The typical escalation is: warning → suspension → termination.
